CLIENT IMAGE RELEASE, COPYRIGHT & DIGITAL FILE RESPONSIBILITY NOTICE

Image Release
Upon completion of your purchase and delivery of your selected digital images, Torres Fine Art Photography Studios (“Torres Fine Art”) releases those purchased images to the client for personal use in accordance with the terms of the applicable photography agreement and any image-use license provided.
Digital image delivery constitutes the completion of Torres Fine Art’s responsibility for maintaining and safeguarding those delivered files, unless the client has separately purchased archival services.
Copyright & Ownership
All photographs created by Torres Fine Art Photography Studios remain the intellectual property and copyrighted works of Torres Fine Art Photography Studios unless a separate written copyright transfer has been expressly executed.
Purchase of a digital image, print, album, or other photographic product does not constitute a transfer of copyright ownership.
Unless otherwise specified in writing, the client receives a personal, non-exclusive, non-transferable license to use purchased digital images for personal purposes consistent with the terms of the applicable photography agreement.
The client may:
Download and retain copies of the delivered images for your personal records and archival purposes.
Print the images through a professional lab, consumer photo printer, or other printing service of your choice.
Create personal photo books, albums, cards, gifts, wall art, and other physical reproductions for yourself, your family, or members of your group, provided such items are not produced for resale.
Share the images with family and friends for their personal use.
Post the images to your personal social media accounts, including Facebook, Instagram, TikTok, X, Threads, and similar platforms.
Use individual images as personal profile photographs, avatars, or account images.
Use individual images as personal headshots or profile photographs on personal websites, personal portfolios, Twitch or other personal streaming profiles, and similar personal online accounts.
Share the images electronically by text message, email, private messaging, or other personal communication.
Use the images for personal announcements, celebrations, invitations, scrapbooks, keepsakes, or other non-commercial personal projects.
Crop or resize an image as reasonably necessary for a particular personal platform or printing format, provided the photograph is not otherwise altered, manipulated, filtered, or materially edited.
Give copies of the delivered images to members of the photographed group for their own personal use, subject to the same terms and restrictions contained in this release.
COPYRIGHT & OWNERSHIP
All photographs remain the copyrighted intellectual property of Torres Fine Art Photography Studios. This personal-use license grants permission to use the delivered images in the ways specifically described above; it does not transfer copyright, ownership, or exclusive rights to any photograph.
This license is granted to the individuals depicted in the delivered images for their personal use. It does not grant permission to any third party, business, organization, publication, brand, sponsor, or commercial entity to use the photographs beyond the personal uses described above.
Any use not expressly permitted by this release requires prior written permission from Torres Fine Art Photography Studios.
Copyright ownership includes, but is not limited to, the exclusive rights to reproduce, distribute, publicly display, publicly perform, publish, create derivative works from, license, sell, or otherwise commercially exploit the photographs.
The client may not:
Sell, license, sublicense, or otherwise commercially distribute the images;
Claim authorship or copyright ownership of the images;
Submit the images for publication, commercial campaigns, contests, competitions, or other third-party use where ownership or commercial rights are required without written permission;
Alter, manipulate, heavily edit, filter, or create derivative works from the photographs in a manner that materially changes the artistic integrity of the work without written permission;
Remove copyright notices, metadata, watermarks, or other identifying information where present; or
Transfer purchased digital files to another person or entity for their own commercial use.
Normal personal sharing on social media is permitted when consistent with the applicable image-use license. When sharing images publicly, clients are encouraged to provide appropriate credit to Torres Fine Art Photography Studios where reasonably possible.
Commercial & Third-Party Use
Any commercial, advertising, promotional, editorial, publication, organizational, business, resale, or third-party use of the photographs requires prior written permission and may require the purchase of an additional commercial usage license.
The client may not assume that purchasing a digital file grants commercial rights to the image.
Where an image is created for a business, organization, publication, campaign, or other commercial purpose, usage rights will be governed by the applicable contract, licensing agreement, or written authorization.
Copyright Transfer
A complete transfer of copyright ownership is not included with standard photography services or the purchase of digital images.
If a client requires copyright ownership to be transferred, such transfer must be expressly negotiated and documented in a separate written copyright assignment signed by Torres Fine Art Photography Studios.
Any copyright transfer must specifically identify the images and rights being transferred.
Payment for photographic services or digital files alone does not constitute a copyright transfer.
Client Responsibility for Digital Files
Once digital images have been delivered, the client is solely responsible for downloading, storing, and backing up their files.
Torres Fine Art strongly recommends that clients maintain multiple copies of their purchased images in separate, secure locations, such as:
An external hard drive or other physical storage device;
A reputable cloud-storage service; and
An additional backup location separate from the primary storage device.
Torres Fine Art is not responsible for backing up, preserving, replacing, or recovering digital images after delivery unless the client has purchased a separate archival service agreement.
If a client loses, damages, deletes, corrupts, or otherwise becomes unable to access delivered digital files, Torres Fine Art is not obligated to replace or recover those files unless they remain available within an active archival service purchased by the client.
Archival Services
Archival storage and backup are not automatically included with the purchase of digital images.
Clients who wish for Torres Fine Art to maintain an archival copy of their purchased imagery must purchase an applicable archival service. The terms, duration, storage limitations, renewal requirements, and fees associated with archival services will be provided separately.
Archival services are intended as an additional preservation service and should not be considered a substitute for the client maintaining their own independent backups.
Even when archival services have been purchased, clients are encouraged to maintain their own copies of all delivered imagery.
Printing & Image Quality
Torres Fine Art takes considerable care in preparing images for professional reproduction. However, the appearance of an image can vary significantly depending upon the printer, printing process, paper or substrate, color profile, monitor, display settings, laboratory, and other equipment or materials used.
For this reason, Torres Fine Art cannot guarantee the color, contrast, sharpness, tonal range, cropping, resolution, or overall appearance of images printed or reproduced by third-party laboratories, retailers, consumer printers, websites, or other vendors not selected or provided by Torres Fine Art.
Torres Fine Art is not responsible or liable for the quality, color accuracy, resolution, cropping, or overall appearance of imagery when the client chooses to print or reproduce the images through a third party.
Clients who desire professional-quality prints and products are encouraged to order them directly through Torres Fine Art or through a professional print laboratory recommended by Torres Fine Art.
Professional Printing
When images are printed through Torres Fine Art, we are able to exercise greater control over the production process, including image preparation, color management, print materials, sizing, and quality control.
Any concerns regarding the quality of a product printed through Torres Fine Art should be reported promptly so that we may evaluate the issue and, where appropriate, work with our professional laboratory to resolve it.
Important Notice Regarding Digital Files
Digital files are provided as a convenience and are not intended to replace professionally produced archival artwork.
The purchase of a digital image does not constitute the purchase of permanent digital storage, indefinite cloud storage, data-recovery services, or lifetime backup services.
Unless otherwise expressly stated in writing, all delivered digital files are considered the client's responsibility once they have been successfully delivered.
By accepting delivery of digital images, the client acknowledges and agrees that:
The client is responsible for downloading and securely storing delivered files.
Torres Fine Art is not responsible for maintaining backup copies after delivery unless archival services have been separately purchased.
Torres Fine Art is not responsible for lost, deleted, damaged, corrupted, or inaccessible files after delivery unless covered by an active archival service.
Torres Fine Art retains copyright ownership of the photographs unless a separate written copyright transfer has been executed.
Purchase of a digital file does not constitute purchase or transfer of copyright.
Commercial, publication, advertising, resale, or third-party use may require additional written permission or licensing.
Torres Fine Art does not guarantee the quality of images printed through third-party vendors.
Torres Fine Art is not responsible for differences in color, contrast, sharpness, cropping, resolution, or appearance resulting from third-party printing or display.
Professional printing and heirloom products purchased through Torres Fine Art are subject to the quality standards and policies applicable to those products.
Please protect your imagery. These photographs represent moments that cannot be recreated, and maintaining your own independent backup is one of the most important things you can do to preserve them for future generations.
